Terms & Conditions
This is a courtesy translation. The Dutch terms and conditions are the legally binding version; in the event of any discrepancy, the Dutch text prevails.
1. Who are we?
Pawtrait Atelier ("we") is established in Nederland, registered with the Chamber of Commerce (KvK) under 00000000, VAT NL000000000B01. For questions: hallo@pawtraitatelier.com.
2. Applicability
These terms apply to all orders you place via pawtraitatelier.com. By checking out you accept these terms.
3. The agreement
The agreement comes into being at the moment you complete your order and we have received payment. You receive a confirmation by email immediately thereafter.
4. Made-to-order product — exclusion of the right of withdrawal
Your portrait is made at your request and from your own photograph. It is thereby a made-to-order product. In accordance with Article 6:230p sub f of the Dutch Civil Code, no statutory 14-day right of withdrawal applies to such products. This is confirmed once more at checkout via an explicit consent checkbox.
5. Satisfaction guarantee
We personally vouch for the quality of every portrait. If you are not satisfied with the print or the frame, contact us within 14 days of receipt. We will seek a fitting solution: a reprint, a partial refund, or — in exceptional cases — a full refund.
6. Delivery
We deliver within the Netherlands and, on request, within the EU. Our average delivery time is five working days after you approve your final preview (production and shipping via PostNL). We deliberately print only after your approval. In the event of delay we will inform you by email as soon as possible.
7. Prices and VAT
All prices on the website include 21% VAT. Shipping costs are calculated at checkout and depend on the chosen format.
8. Copyright and use of photographs
You warrant that you hold the rights to the photograph you upload. We use your photograph only for the performance of your order and for our own quality control. We do not use your photograph for advertising or training data without your explicit written consent.
9. Liability
Our liability is limited to the amount of the order in question. We are not liable for indirect damage, lost profit, or damage caused by third parties.
10. Applicable law
These terms are governed by Dutch law. Disputes are submitted to the competent court in the district where we are established, unless the law provides otherwise.
